Rules for Jewellers in United States

Reviewed October 2026. Check the sources for the latest rules before acting on them.

Making charges and pricing

US jewellery is usually sold at a price for the finished item rather than as metal weight plus a separate labour charge. Retail prices reflect the cost of metal, stones and manufacturing plus the store's markup; doubling the wholesale cost is traditionally called keystone pricing, although markups vary widely. Custom work, casting, sizing and repairs are normally quoted per job.

In the bench and refining trade, metal is weighed in pennyweights (dwt) or grams. Refiners and scrap buyers typically pay a percentage of the melt value of the fine gold they recover, after assay and refining charges.

Hallmarking and purity marks

The US has no compulsory hallmarking and no government assay office: marking is voluntary, but any mark must be accurate. Under the National Gold and Silver Stamping Act (15 U.S.C. chapter 8), the gold tested, excluding solder, may be no more than 3 parts per thousand below the stamped fineness. When the whole item is tested with its solder, the limit is 7 parts per thousand (3 for watchcases and flatware). A manufacturer or dealer that applies a quality mark such as 14K or 585 must also apply its name or a trademark that is registered, or applied for, in the US.

The FTC Jewelry Guides (16 CFR Part 23) set out how to describe precious metals without misleading buyers. The word gold on its own implies 24 karat; an alloy may be called gold only if the word is preceded by its karat, shown just as clearly (for example, 14 Karat Gold or 9 Kt. Gold). Terms such as gold filled, gold plate and vermeil have defined meanings, with a minimum of 10 karat for the gold layer.

Tax on sales and scrap

There is no federal VAT or GST. Retail jewellery sales are subject to state and local sales tax, and rates, exemptions and rules on bullion and coins vary by state. Jewellers buying stock for resale normally give suppliers a resale certificate instead of paying sales tax. Sales tax is generally not due when you buy old gold from a member of the public, because it falls on retail sales.

Check the rules in each state where you sell with that state's revenue department.

Customer checks and reporting

FinCEN's rule for dealers in precious metals, precious stones or jewels (31 CFR Part 1027) requires a written anti-money-laundering programme from businesses that, in the previous calendar or tax year, both bought more than $50,000 of covered goods and received more than $50,000 from selling them. Finished jewellery counts only if at least half its value comes from precious metals, stones or jewels, and only that part of its value is counted. A retailer is covered only if it bought more than $50,000 of covered goods from sources other than dealers or other retailers, such as members of the public. The programme must be approved by senior management and include risk-based policies, a compliance officer, ongoing training and independent testing.

Any business that receives more than $10,000 in cash in one transaction or in related transactions must file Form 8300 within 15 days and give the customer a written statement by 31 January of the following year. Many states and cities also license or register precious-metal and second-hand dealers who buy from the public. These rules often require the seller's ID, transaction records (sometimes reported to police) and a holding period before items are melted or resold. Requirements differ by state.

Jewellers in United States: FAQ

What is the scrap gold price per gram in the United States today?

The melt value of gold today is about $128.41 per gram for 24K, $117.74 per gram for 22K, $96.40 per gram for 18K, $75.19 per gram for 14K, $53.60 per gram for 10K, at the international spot price converted to USD (Oct 23, 2026 · 5:00 PM EDT). Buyers of scrap pay a percentage of this melt value to cover refining, assaying and their margin; use the scrap column on this page to work out your own buying price.

How do jewellers calculate the scrap value of gold?

Weigh the item (in grams or pennyweights; 1 dwt = 1.555 g) and multiply by its purity to get the fine gold content: for example 0.417 for 10K, 0.585 for 14K and 0.750 for 18K. Then multiply the result by the spot price per gram or per dwt. Buyers pay a percentage of that melt value to cover assay, refining and margin.

Is sales tax charged when a jeweller buys scrap gold from the public?

Generally no. Sales tax falls on retail sales, not on your purchase of old gold from a member of the public, although state second-hand dealer rules may require ID and records.

Do I have to stamp the karat on gold jewellery?

No, marking is voluntary in the US. If you do stamp a quality mark, it must be within the National Gold and Silver Stamping Act tolerances (3 parts per thousand, or 7 when solder is included), and you must also apply your name or a registered or applied-for trademark.

What reporting applies to cash sales over $10,000?

A business that receives more than $10,000 in cash in one transaction or in related transactions must file Form 8300 within 15 days. Dealers above FinCEN's $50,000 thresholds also need an AML programme.
