Rules for Jewellers in Germany
Reviewed October 2026. Check the sources for the latest rules before acting on them.
Making charges and pricing
German retail jewellery is usually sold at a price for the finished piece, and prices shown to consumers must include 19% VAT. Goldsmiths quote bespoke work, alterations and repairs per job, often as material plus labour (Material + Arbeitslohn), and some chains and simple pieces are priced by weight. In the trade, metal is bought and sold per gram by fineness, and refiners (Scheideanstalten) quote daily buying and selling prices for fine gold.
When buying old gold (Altgold), jewellers and gold buyers check the stamp or test the piece (touchstone or XRF), weigh it and pay for the fine gold content at their own buying rate, which allows for refining costs (Scheidekosten) and margin. Old gold taken in part-exchange is credited against the new piece in the same way.
Hallmarking and purity marks
Germany has no compulsory hallmarking and no state assay office. The Feingehaltsgesetz of 1884 (law on the fineness of gold and silver goods) applies only when a fineness is stamped. Jewellery (Schmuckwaren) may be stamped with any fineness, stated in thousandths, and when the whole piece is melted down with its solder it may fall short of the mark by no more than 10 thousandths. For gold utensils (Geräte) the minimum stamp is 585 and the tolerance 5 thousandths. Common jewellery marks are 333, 375, 585 and 750. Goods filled with other metals may not carry a fineness mark.
The seller is liable for the accuracy of the stamped fineness, and so is the business for which the piece was stamped in Germany. Breaches are administrative offences punishable by fines of up to €5,000, and the goods can be confiscated.
Tax on sales and scrap
Jewellery carries 19% VAT (Umsatzsteuer) on the full price. Investment gold is exempt under §25c UStG: bars and wafers of at least 995 fineness in weights accepted by the bullion markets, and gold coins of at least 900 fineness minted after 1800 that are or were legal tender and normally sell for no more than 80% above the value of their gold. Second-hand jewellery bought without VAT, for example from a private person, can be resold under the margin scheme (Differenzbesteuerung, §25a UStG), so VAT is due only on the margin. Precious metals as such, including fine gold and scrap (tariff positions 7108 and 7112), are excluded from the scheme.
No VAT arises when you buy old gold from a private person. Between businesses the reverse charge (§13b UStG) applies to gold of at least 325 thousandths in raw or semi-finished form, including bars roughly melted from scrap (§13b(2) no. 9), and to precious-metal waste and scrap (§13b(2) no. 7 with Anlage 3). The buying business, not the seller, then accounts for the VAT. Finished jewellery sold as jewellery is taxed in the normal way; check borderline cases with your tax adviser.
Customer checks and reporting
Every business that trades in goods is an obliged entity (Güterhändler) under the Geldwäschegesetz (GwG). Dealers must have risk management and carry out customer due diligence when they make or receive cash payments of €2,000 or more for precious metals such as gold, silver and platinum, in one transaction or linked ones; for jewellery, watches and other goods the cash threshold is €10,000. Under the Länder's joint guidance, the €2,000 threshold applies where the price is essentially set by the metal weight, as when buying old gold (old jewellery, dental gold), while finished jewellery priced above its metal value falls under €10,000. Before the deal is binding they must identify the customer from an official photo ID (and copy it), identify any beneficial owner and check for politically exposed persons. Records must be kept for five years. Suspicious transactions must be reported to the Financial Intelligence Unit (FIU) at the customs service through goAML, whatever the amount, and dealers in jewellery, watches, precious metals and stones have had to register on goAML since 1 January 2024 even if they have never filed a report. Supervision lies with the authorities of each Land.
From 10 July 2027 the EU Anti-Money Laundering Regulation (EU) 2024/1624 applies directly: cash payments to businesses of more than €10,000 will be banned across the EU, and dealers in precious metals and stones will be obliged entities whether or not they take cash. Buying and selling precious metals, jewellery and gemstones as a specialised second-hand dealer is also a monitored trade under §38 GewO, so after the business is registered the trade office checks the owner's reliability with a certificate of good conduct and an extract from the central trade register.

Jewellers in Germany: FAQ
What is the scrap gold price per gram in Germany today?
The melt value of gold today is about €114.48 per gram for 999 (Feingold, 24K), €104.97 per gram for 916 (22K), €85.94 per gram for 750 (18K), €67.04 per gram for 585 (14K), €42.97 per gram for 375 (9K), €38.16 per gram for 333 (8K), at the international spot price converted to EUR (Oct 23, 2026 · 11:00 PM CEST). Buyers of scrap pay a percentage of this melt value to cover refining, assaying and their margin; use the scrap column on this page to work out your own buying price.
How do German jewellers work out the value of old gold?
Weigh the piece, check its fineness stamp (for example 333, 585 or 750) or test it, and multiply the weight by the fineness to get the fine gold content. Value that at the gold price per gram on this page. Buyers and refiners pay a percentage of that figure to cover refining costs and margin.
Is VAT charged when I sell old gold to a refiner?
Yes, but under the reverse charge. When one business sells precious-metal scrap, or gold of 325 thousandths or more in raw or semi-finished form, to another, the buyer accounts for the 19% VAT under §13b UStG and you invoice net. No VAT arises when you buy the old gold from a private person.
Do I have to stamp the fineness on gold jewellery in Germany?
No, marking is voluntary. If you do stamp a fineness, it must be stated in thousandths, and the piece melted down with its solder may fall short of it by no more than 10 thousandths (Feingehaltsgesetz).
When must I check a customer's ID under the GwG?
When you make or receive cash payments of €2,000 or more for precious metals, including old gold bought at its metal value, or of €10,000 or more for finished jewellery and watches, single or linked, and whenever you suspect money laundering. You must also be registered with the FIU on goAML.
